The plaintiff in error John J. Huebner was convicted of the crime of attempting to persuade or entice a child under eighteen years of age into his motor vehicle with intent to commit a crime against sexual morality in violation of sec. 939.32, Stats., the attempt statute, and sec. 944.12. The trial was to the court, which ordered a presentence social, physical and mental examination under sec. 959.15 (2), relating to sex crimes, and he was committed to the state department of public welfare upon its recommendation that he needed treatment. Huebners motions to dismiss the action and for judgment of acquittal, or in the alternative for a new trial, were denied as was his motion to vacate the sentence and for resentencing. To bring before this court the issues involved in the judgment, sentencing and denial of the motions, three writs of error were issued and consolidated in this appeal.
